LEGAL GUIDE · MEDIATION AND ARBITRATION

Court-annexed, private and pre-litigation mediation

Court-annexed mediation follows a referral and the court's applicable framework. Private mediation begins from the parties' arrangement. Pre-litigation mediation may arise under a specific statutory process. The choice affects procedure, records, cost and the route for giving a settlement legal effect.

What to examine

Identify whether a case is pending, whether a pre-institution requirement applies and whether all necessary parties will participate. In J&K, court-annexed arrangements should be checked against the High Court's current mediation rules and referral directions. A privately selected mediator does not automatically act as a court or statutory authority. Clarify authority and process before paying fees or signing terms.

Records to collect

  • Pending pleadings or demand
  • referral or mediation agreement
  • party authority
  • applicable rules and fee terms

Keep complete, dated copies and preserve originals. Note which records are missing and where they may be requested; do not alter a document to fill a gap in the history.

The applicable framework

Mediation is a process for exploring lawful agreement; arbitration is an adjudicatory process based on the applicable legal framework. The agreement, referral, institution and effective statutory provisions matter. A procedural label alone does not establish confidentiality, enforceability, court jurisdiction or the time available for a challenge.

A practical next step

Choose the route that fits the dispute and required settlement effect. Record scope, participants, confidentiality and next steps before the first substantive session.
