LEGAL GUIDE · GOVERNMENT EMPLOYEES, RECRUITMENT AND CAT

Challenging a disproportionate departmental penalty

A challenge to a departmental penalty should address the findings, procedure and reasons for the sanction. Judicial review is not simply a fresh appeal on every factual disagreement, and describing a penalty as harsh does not alone establish the legal ground.

What to examine

Identify the proved charges, evidence relied on, employee's defence and factors considered in choosing the penalty. Preserve the inquiry report and opportunity given to respond. A proportionality argument should explain the legal and factual basis, while keeping any procedural unfairness claim distinct.

Records to collect

  • Charge and defence
  • inquiry report
  • penalty order
  • service record and departmental appeal

Keep complete, dated copies and preserve originals. Note which records are missing and where they may be requested; do not alter a document to fill a gap in the history.

The applicable framework

For J&K employment matters, identify the governing service or recruitment rules and amendments before applying a general principle. CAT coverage depends on the employer and subject matter, while territorial allocation is a separate question. The High Court copy of the CCA Rules is a starting text for covered matters, not proof that every employee or issue falls under those Rules.

A practical next step

Organise grounds by finding, procedure and penalty. Identify the available departmental remedy and relevant filing dates before approaching the appropriate forum.
