Deputation ends early — repatriation and posting disputes
A deputation dispute depends on the governing terms, parent and borrowing organisations and the reason for repatriation. Deputation should not automatically be treated as a right to remain in a particular post for every stated period.
What to examine
Distinguish early repatriation, refusal of extension, absorption and the next posting. Examine any notice, undertaking, adverse allegation and applicable rule. Where an order has punitive features, procedural questions may arise, but the substance and record require assessment. Disclose related parent-department instructions.
Records to collect
- Deputation terms
- extension or repatriation order
- relevant communications
- parent-department posting
Keep complete, dated copies and preserve originals. Note which records are missing and where they may be requested; do not alter a document to fill a gap in the history.
The applicable framework
For J&K employment matters, identify the governing service or recruitment rules and amendments before applying a general principle. CAT coverage depends on the employer and subject matter, while territorial allocation is a separate question. The High Court copy of the CCA Rules is a starting text for covered matters, not proof that every employee or issue falls under those Rules.
A practical next step
Identify the particular right claimed and practical joining obligations. Assess the order and applicable policy rather than relying only on an expected tenure.
