MSME delayed-payment remedies — eligibility matters

The MSMED delayed-payment mechanism is directed to qualifying micro and small suppliers under the governing law. A business describing itself as an MSME is not enough to establish eligibility for every invoice. Status, activity, registration timing and the transaction require examination.

What to examine

Collect the enterprise registration history, purchase order, supply or service dates, acceptance record and payment terms. A later registration should not be assumed to cure every earlier eligibility issue. Medium enterprises and trading activities need particular assessment. The Samadhaan portal is a filing entry point; the competent Facilitation Council and statutory process determine the matter.

Records to collect

  • Udyam or earlier registration history
  • purchase order
  • invoice and acceptance evidence
  • payment and interest calculation

Keep complete, dated copies and preserve originals. Note which records are missing and where they may be requested; do not alter a document to fill a gap in the history.

The applicable framework

Business records should identify the legal entity, agreed terms, performance and exact amount or decision disputed. Commercial-court procedure, arbitration and sector-specific mechanisms can impose different preliminary steps and remedies. A contract label or a business address alone does not determine the competent forum or establish personal liability.

A practical next step

Check statutory supplier eligibility and the relevant dates before choosing the Council route. Keep the full filing and conciliation or arbitration record if proceedings follow.
