LEGAL GUIDE · MEDIATION AND ARBITRATION
Enforcing an arbitral award in India
Enforcement depends on the award's legal category, enforceability, any challenge or stay and the assets against which relief is sought. Domestic and foreign awards follow different statutory frameworks. A signed award does not itself transfer money or override a stay.
What to examine
For a covered domestic award, section 36 must be read with the challenge and stay position. Foreign awards require the relevant recognition and enforcement analysis. Identify the correct debtor and lawfully available asset information, not merely an associated person's property. Update the account for interest, costs and payments without expanding the award.
Records to collect
- Award and arbitration agreement
- receipt and challenge record
- stay orders if any
- payment and asset information
Keep complete, dated copies and preserve originals. Note which records are missing and where they may be requested; do not alter a document to fill a gap in the history.
The applicable framework
Mediation is a process for exploring lawful agreement; arbitration is an adjudicatory process based on the applicable legal framework. The agreement, referral, institution and effective statutory provisions matter. A procedural label alone does not establish confidentiality, enforceability, court jurisdiction or the time available for a challenge.
A practical next step
Prepare an enforcement and jurisdiction note suited to the award and debtor assets. Keep the court informed of payments or settlements affecting the amount due.
