Partition and inheritance in Kashmir — documents to prepare
The useful starting point is the property’s ownership history and the family record, rather than an assumed share or a single revenue entry.
Identify the property precisely
Record the village or locality, survey or khasra details where applicable, area and boundaries. Collect the title documents, available maps and current revenue record. Where there are multiple properties, prepare a separate entry for each.
Build the ownership and family history
List how the property came to the present or deceased owner. Include purchases, gifts, earlier inheritance, partitions, settlements and court decrees. Collect the relevant instruments and death certificates.
Prepare a family tree with accurate names and relationships. The applicable succession law and any valid will or earlier instrument can change the analysis. Do not begin with an assumption that all relatives receive the same share.
Distinguish title, entries and possession
Revenue entries, title instruments and evidence of physical possession are different parts of the record. A disputed entry should be checked against the document or legal event on which it rests.
Note who occupies the property, who receives rent and whether any portion has been sold, built on or leased. Retain relevant agreements, receipts and dated communications.
Record earlier proceedings
Disclose prior revenue applications, civil suits, settlements, decrees and pending appeals. An earlier decision may affect both the forum and the relief now available.
Discuss the possible route
Partition, declaration, possession, correction of an entry and negotiated division are different possibilities. The correct route depends on the property, the disagreement and the authority competent to decide it. Urgent concerns about transfer or dispossession should be raised with dates and evidence.
Prepare for the next step
Keep a complete copy of your records and a short chronology. If there is a live hearing, order or response deadline, mention it before arranging a discussion.
