Property & revenue matters
Understanding a Kashmir property dispute starts with the title history, the revenue record and who is in possession.
The matters covered
The practice considers ownership, partition, inheritance, possession, boundary and tenancy disputes, alongside challenges involving land records and revenue orders. Civil and revenue questions may require different proceedings.
A sale document, mutation entry, family arrangement and record of possession serve different purposes. They must be read together. The applicable succession law, land category and local restrictions can materially affect the advice.
Records for an initial review
- Title documents and the chain of transfers, including registered instruments.
- Current and historical revenue entries, mutations and available maps.
- Death certificates, family details, wills or earlier partition documents where relevant.
- Tenancy agreements, rent records, notices, photographs and prior orders.
How the next step is assessed
The review identifies the precise property, the competing claim and the forum that can decide it. Missing links in the title or family history should be identified before choosing a remedy.
If construction, dispossession or transfer is threatened, preserve the relevant evidence and explain the dates. Any request for urgent relief needs a supported factual basis.
Questions that often arise
Does a mutation entry settle ownership?
A revenue entry should not be treated as a substitute for examining the underlying title. The document and legal basis of the entry matter.
Can a family property simply be divided equally?
The shares depend on the ownership history, applicable succession law and any valid instruments or earlier partition. A general equal-share assumption may be wrong.
