NRI, OCI and foreign national — property rights need different checks

NRI, OCI and foreign-national status can lead to different property-law checks. Citizenship, overseas residence, purchase and inheritance should not be treated as interchangeable concepts. Agricultural land and other restricted categories require particular current-law scrutiny.

What to examine

Identify the buyer or heir's actual status, property classification, acquisition mode and applicable FEMA and local land-law conditions. A POA changes who acts, not whether the principal is legally eligible. Do not infer acquisition rights from an Indian bank account or an OCI card without checking the transaction category.

Records to collect

  • Citizenship and status documents
  • property classification
  • proposed acquisition terms
  • permission or exemption record

Keep complete, dated copies and preserve originals. Note which records are missing and where they may be requested; do not alter a document to fill a gap in the history.

The applicable framework

A Kashmir matter involving someone abroad can require both Indian legal compliance and documents executed in another country. Authentication, stamping, registration, authority and appearance are separate questions. An apostille or consular act does not by itself decide the underlying property right, foreign judgment effect or permission required by an Indian court.

A practical next step

Obtain a status-and-transaction assessment using current official rules. Keep acquisition eligibility, money movement and registration as separate checks.
