LEGAL GUIDE · KASHMIR MATTERS FOR PEOPLE LIVING ABROAD

Revoking a power of attorney used for Kashmir property

Revoking a power of attorney requires examining the instrument, the governing law and acts already performed. Signing a revocation without communicating it appropriately may leave practical risks. The label irrevocable should also be examined rather than accepted as the complete legal answer.

What to examine

Identify any interest claimed by the agent, ongoing transaction and third parties who may rely on the authority. Revocation does not automatically undo an earlier valid act. Registration, notice and record updates may require distinct steps. Keep proof of delivery and coordinate any urgent protection of the property.

Records to collect

  • Original POA
  • revocation terms
  • transaction history
  • agent and third-party communications

Keep complete, dated copies and preserve originals. Note which records are missing and where they may be requested; do not alter a document to fill a gap in the history.

The applicable framework

A Kashmir matter involving someone abroad can require both Indian legal compliance and documents executed in another country. Authentication, stamping, registration, authority and appearance are separate questions. An apostille or consular act does not by itself decide the underlying property right, foreign judgment effect or permission required by an Indian court.

A practical next step

Prepare an authority-and-notice plan, including relevant receiving offices. Assess completed acts and future restrictions separately.
