LEGAL GUIDE · GOVERNMENT EMPLOYEES, RECRUITMENT AND CAT
Objecting to a seniority list
An objection to seniority should identify the applicable rule, disputed placement and effect on the employee's rights. Joining date, selection rank and promotion date are not interchangeable measures under every service regime.
What to examine
Obtain the full provisional or final list, its publication date and relevant appointment or promotion records. Identify employees whose position would be affected. Preserve objections already made and the authority's response. A general grievance about being senior in age or service does not replace the rule-based comparison.
Records to collect
- Seniority list
- governing rule
- appointment and promotion orders
- objection record
Keep complete, dated copies and preserve originals. Note which records are missing and where they may be requested; do not alter a document to fill a gap in the history.
The applicable framework
For J&K employment matters, identify the governing service or recruitment rules and amendments before applying a general principle. CAT coverage depends on the employer and subject matter, while territorial allocation is a separate question. The High Court copy of the CCA Rules is a starting text for covered matters, not proof that every employee or issue falls under those Rules.
A practical next step
Prepare a placement comparison showing the rule and dates relied on. Assess the proper stage, parties and remedy before seeking consequential promotion relief.
