LEGAL GUIDE · CRIMINAL PROCESS AND BAIL

Passport or overseas travel during a criminal case

Permission to travel, release of a deposited passport and action by the passport authority are separate issues. Start with the bail order and every operative travel restriction. A valid passport or booked flight does not override a court condition.

What to examine

A travel request should specify destination, purpose, dates, contact address and a practical return undertaking supported by records. Identify whether the passport is held by the court, police or passport authority and whether another proceeding imposes restrictions. Foreign visa requirements are separate. Apply before travel rather than treating a pending application as permission.

Records to collect

  • Bail and travel orders
  • passport custody record
  • itinerary and purpose documents
  • other pending-case details

Keep complete, dated copies and preserve originals. Note which records are missing and where they may be requested; do not alter a document to fill a gap in the history.

The applicable framework

Criminal procedure must be matched to the alleged offence, case stage, applicable special statute and any transition from the older laws. Bail, investigation, trial and property-release questions can follow different provisions. Official case information helps locate the matter; the complete police and court records are needed to assess the particular application.

A practical next step

Ask the competent forum for the precise permission or variation required and keep the signed order available. Reconfirm reporting and return obligations before departure.
