LEGAL GUIDE · CRIMINAL PROCESS AND BAIL
Preserving phone messages and other digital evidence
Preserve the original device, complete conversation and relevant account or file information when digital evidence may matter. A cropped screenshot can omit context and may not meet the requirements for proving an electronic record. Do not edit, delete or fabricate messages.
What to examine
Record how and when the material was obtained and retain lawful backups in their original form where possible. Forwarded files may lose useful metadata. Accessing another person's account without authority can create separate legal problems. The required certificate, authenticity evidence and production method should be assessed under the applicable evidence law and procedure.
Records to collect
- Original device and account details
- complete message or email export
- file dates and source
- any earlier copies supplied
Keep complete, dated copies and preserve originals. Note which records are missing and where they may be requested; do not alter a document to fill a gap in the history.
The applicable framework
Criminal procedure must be matched to the alleged offence, case stage, applicable special statute and any transition from the older laws. Bail, investigation, trial and property-release questions can follow different provisions. Official case information helps locate the matter; the complete police and court records are needed to assess the particular application.
A practical next step
Create a secure preservation copy and an inventory without changing originals. Obtain advice on lawful access, relevance and the proper method of producing the record.
