LEGAL GUIDE · GOVERNMENT EMPLOYEES, RECRUITMENT AND CAT
Reasonable accommodation for an employee with a disability
A request for disability-related accommodation should identify the applicable rights framework, job functions, disability-related barrier and practical adjustment sought. It is different from a blanket request to remove every duty or an assumption that the employer may ignore the request.
What to examine
Use relevant medical and disability documentation lawfully and disclose only what is needed. Explain how the proposed adjustment would address the barrier and whether alternatives were considered. Keep recruitment, continued employment, accessibility and leave issues distinct, since each may involve different provisions and decision-makers.
Records to collect
- Relevant disability documentation
- job duties
- accommodation request
- employer response
Keep complete, dated copies and preserve originals. Note which records are missing and where they may be requested; do not alter a document to fill a gap in the history.
The applicable framework
For J&K employment matters, identify the governing service or recruitment rules and amendments before applying a general principle. CAT coverage depends on the employer and subject matter, while territorial allocation is a separate question. The High Court copy of the CCA Rules is a starting text for covered matters, not proof that every employee or issue falls under those Rules.
A practical next step
Make a specific, workable proposal and seek a reasoned decision. Assess any refusal against the applicable framework and the actual employment circumstances.
