LEGAL GUIDE · KASHMIR MATTERS FOR PEOPLE LIVING ABROAD
The person who granted a power of attorney has died
Death of the principal raises immediate questions about the continuing authority of a POA and the succession to the underlying property. Ordinary agency and legally recognised interests or completed acts may need different treatment. Do not assume the document remains usable simply because it has no expiry date.
What to examine
Record the death, agent's knowledge, transaction dates and scope of the instrument. Distinguish an act before death from one later attempted and identify any claimed exception under the governing law. Heirs may need a new legal basis to act; the former agent's role does not itself establish inheritance rights.
Records to collect
- POA
- death certificate
- transaction chronology
- succession records
Keep complete, dated copies and preserve originals. Note which records are missing and where they may be requested; do not alter a document to fill a gap in the history.
The applicable framework
A Kashmir matter involving someone abroad can require both Indian legal compliance and documents executed in another country. Authentication, stamping, registration, authority and appearance are separate questions. An apostille or consular act does not by itself decide the underlying property right, foreign judgment effect or permission required by an Indian court.
A practical next step
Notify relevant participants accurately and preserve the existing record. Obtain advice before further execution or registration relying on the old authority.
