Separating from a spouse — securing essential personal documents
When separating, make a secure and lawful copy set of essential personal and child-related records. Preparation should preserve access to information without taking another person's property unlawfully, entering private accounts or placing the family at additional risk.
What to examine
Prioritise identification, marriage evidence, children's schooling and medical information, existing orders and records of your own finances. Keep original documents secure where you are entitled to hold them. If a document is withheld, record the issue and consider lawful replacement or production procedures. A private cloud folder should not become a public evidence archive.
Records to collect
- Identity and relationship records
- children's essential records
- your financial statements
- orders and relevant communications
Keep complete, dated copies and preserve originals. Note which records are missing and where they may be requested; do not alter a document to fill a gap in the history.
The applicable framework
The applicable family-law route depends on the marriage, personal or statutory law, parties and relief sought. Maintenance, protection, custody, divorce and property claims may proceed under different provisions. Existing orders must be disclosed and followed unless lawfully varied. A family relationship alone does not determine jurisdiction or every financial entitlement.
A practical next step
Make an indexed copy set and a short chronology. Identify missing records and any immediate safety or access concern before beginning negotiations or proceedings.
