LEGAL GUIDE · GOVERNMENT EMPLOYEES, RECRUITMENT AND CAT

Subsistence allowance has not been paid

Unpaid subsistence allowance should be assessed under the employee's applicable service rules, suspension status and any prescribed conditions. It should not be treated as identical to ordinary salary or resolved by assuming a fixed rate for all employees.

What to examine

Collect the suspension order, sanctioned allowance, payment history and any required certificate or communication. Identify why payment is withheld and whether attendance or participation in the inquiry is affected. A request should quantify the unpaid period and address stated objections rather than simply repeat a demand for full salary.

Records to collect

  • Suspension order
  • allowance sanction
  • payment ledger
  • required declarations and correspondence

Keep complete, dated copies and preserve originals. Note which records are missing and where they may be requested; do not alter a document to fill a gap in the history.

The applicable framework

For J&K employment matters, identify the governing service or recruitment rules and amendments before applying a general principle. CAT coverage depends on the employer and subject matter, while territorial allocation is a separate question. The High Court copy of the CCA Rules is a starting text for covered matters, not proof that every employee or issue falls under those Rules.

A practical next step

Make a supported period-wise claim and preserve acknowledgment. Identify urgent prejudice and assess the appropriate departmental or legal route.
