LEGAL GUIDE · PROPERTY, INHERITANCE AND REVENUE RECORDS

The buyer has not paid the full sale price

The seller's remedy for an unpaid balance depends on whether the transaction remains contractual, a deed has been executed and what the documents say about payment. An unpaid amount does not justify assuming that every completed transfer can simply be cancelled.

What to examine

Read the operative deed and agreement together, including acknowledgments of consideration, conditions and possession terms. Compare them with the actual payment trail. A recovery claim, a claimed charge or a challenge to the instrument may involve different legal requirements. Do not alter receipts or treat an inaccurate payment acknowledgment as a harmless formality.

Records to collect

  • Executed deed
  • agreement
  • bank and receipt records
  • demands and possession documents

Keep complete, dated copies and preserve originals. Note which records are missing and where they may be requested; do not alter a document to fill a gap in the history.

The applicable framework

For Kashmir property, the revenue entry, registered instrument, physical possession and underlying legal right should be examined separately. Different issues can require different authorities or civil relief. A service directory explains available services but does not replace the governing statute, current notification or an order in the particular matter.

A practical next step

Quantify the unpaid sum with dates and credits. Assess the remedy the documents support before demanding repossession or making a further transfer.
