Regularisation claims by temporary or daily-wage workers
Regularisation requires a legally available basis in the applicable scheme, rules and employment circumstances. Years of work alone should not be presented as a guarantee of permanent appointment. The engagement and any governing policy must be examined.
What to examine
Identify the employer, sanctioned position, appointment method, continuity and qualifications. Distinguish a scheme-based claim from wage recovery or protection against termination. Preserve original engagement terms and avoid describing irregular records as a formal appointment unless supported. Existing litigation and policy cut-off dates may affect the assessment.
Records to collect
- Engagement orders
- attendance and payment records
- applicable scheme
- earlier decisions or litigation
Keep complete, dated copies and preserve originals. Note which records are missing and where they may be requested; do not alter a document to fill a gap in the history.
The applicable framework
For J&K employment matters, identify the governing service or recruitment rules and amendments before applying a general principle. CAT coverage depends on the employer and subject matter, while territorial allocation is a separate question. The High Court copy of the CCA Rules is a starting text for covered matters, not proof that every employee or issue falls under those Rules.
A practical next step
State the precise entitlement claimed and supporting scheme conditions. Keep alternative wage or service claims distinct from a request for regularisation.
