LEGAL GUIDE · KASHMIR MATTERS FOR PEOPLE LIVING ABROAD
A power-of-attorney holder acts beyond the authority given
An agent's authority must be read from the complete power of attorney and applicable law. If the agent allegedly exceeded it, identify the specific act and missing authority. Dissatisfaction with the price or family result is not by itself proof that the power was exceeded.
What to examine
Compare the transaction with restrictions on property, consideration, delegation and self-dealing. Examine knowledge, consent, ratification and third-party rights where relevant. A complaint to the agent does not automatically cancel a deed. Preserve complete documents before demanding reversal or revocation.
Records to collect
- POA
- executed deed or agreement
- payment records
- instructions and communications
Keep complete, dated copies and preserve originals. Note which records are missing and where they may be requested; do not alter a document to fill a gap in the history.
The applicable framework
A Kashmir matter involving someone abroad can require both Indian legal compliance and documents executed in another country. Authentication, stamping, registration, authority and appearance are separate questions. An apostille or consular act does not by itself decide the underlying property right, foreign judgment effect or permission required by an Indian court.
A practical next step
Create a clause-to-act comparison. Assess authority, transaction validity and urgent protective relief using the actual documents.
