LEGAL GUIDE · KASHMIR MATTERS FOR PEOPLE LIVING ABROAD
Several overseas heirs inherit a Kashmir property
Several overseas heirs can coordinate an inheritance matter, but each person's rights and authority must be identified. One family's local representative does not automatically have power to bind every heir or transfer the entire property.
What to examine
Prepare the succession and title record, including intervening deaths and minors. Separate agreement on shares from authority to negotiate, litigate, sign or receive money. Cross-country execution and authentication may require different processes. A proposed settlement should state whose interest is affected and how each required person will participate.
Records to collect
- Family tree and death records
- title chain
- individual authorities
- proposed division or transaction
Keep complete, dated copies and preserve originals. Note which records are missing and where they may be requested; do not alter a document to fill a gap in the history.
The applicable framework
A Kashmir matter involving someone abroad can require both Indian legal compliance and documents executed in another country. Authentication, stamping, registration, authority and appearance are separate questions. An apostille or consular act does not by itself decide the underlying property right, foreign judgment effect or permission required by an Indian court.
A practical next step
Use a claimant-and-authority matrix. Resolve missing participation and authentication before promising completion through a single general POA.
