LEGAL GUIDE · KASHMIR MATTERS FOR PEOPLE LIVING ABROAD
An heir cannot be located or will not participate from abroad
An absent or uncooperative heir does not automatically lose an inheritance interest. The proposed proceeding or transaction must account for that person's rights and the applicable notice and representation process. Silence is not a universal substitute for consent.
What to examine
Distinguish an untraceable person, a known person refusing agreement and someone who lacks legal capacity. Preserve contact attempts and reliable addresses. A consensual sale or settlement may need participation that contested proceedings address differently. Do not sign on another heir's behalf without legally sufficient authority.
Records to collect
- Family and share records
- contact attempts
- known addresses
- authority and existing case papers
Keep complete, dated copies and preserve originals. Note which records are missing and where they may be requested; do not alter a document to fill a gap in the history.
The applicable framework
A Kashmir matter involving someone abroad can require both Indian legal compliance and documents executed in another country. Authentication, stamping, registration, authority and appearance are separate questions. An apostille or consular act does not by itself decide the underlying property right, foreign judgment effect or permission required by an Indian court.
A practical next step
Identify the exact act requiring participation. Assess lawful notice, representation and adjudication options instead of treating non-response as relinquishment.
