LEGAL GUIDE · KASHMIR MATTERS FOR PEOPLE LIVING ABROAD
An overseas witness needs to give evidence in a Kashmir case
An overseas witness may be able to seek permission to give evidence by video, subject to the court's rules and directions. It is different from informally joining a hearing online. Identity, location, documents and the integrity of the evidence process matter.
What to examine
Identify the witness's role, availability, proposed location and technical arrangements. Check current J&K video-conferencing requirements and any need for a coordinating official, oath or original documents. A party's travel inconvenience does not itself guarantee permission. Avoid contacting a witness in a way that influences the evidence.
Records to collect
- Court directions
- witness details
- proposed location and availability
- relevant documents
Keep complete, dated copies and preserve originals. Note which records are missing and where they may be requested; do not alter a document to fill a gap in the history.
The applicable framework
A Kashmir matter involving someone abroad can require both Indian legal compliance and documents executed in another country. Authentication, stamping, registration, authority and appearance are separate questions. An apostille or consular act does not by itself decide the underlying property right, foreign judgment effect or permission required by an Indian court.
A practical next step
Make a specific application or procedural request early. Obtain directions covering identification, documents and examination rather than assuming a routine video link is sufficient.
