LEGAL GUIDE · CRIMINAL PROCESS AND BAIL

Release of a seized vehicle or other property

A seized vehicle, phone or other item is not released merely because the owner requests it at the station. Interim custody or release depends on the seizure, the case, ownership and the competent authority's order. Special confiscation provisions may change the route.

What to examine

Collect the seizure memorandum, registration or purchase record, finance details and case reference. Explain why custody is sought and how the item can remain available as evidence. The order may impose a bond, photographs, production duties or restrictions on sale or alteration. Ownership disputes between claimants must be disclosed.

Records to collect

  • Seizure memorandum
  • FIR or case number
  • ownership and finance records
  • earlier release or confiscation orders

Keep complete, dated copies and preserve originals. Note which records are missing and where they may be requested; do not alter a document to fill a gap in the history.

The applicable framework

Criminal procedure must be matched to the alleged offence, case stage, applicable special statute and any transition from the older laws. Bail, investigation, trial and property-release questions can follow different provisions. Official case information helps locate the matter; the complete police and court records are needed to assess the particular application.

A practical next step

Seek the appropriate interim-custody or release process with complete ownership material. Comply with preservation and production conditions after the item is returned.
