A government tender bid is rejected
A rejected tender bid should be compared with the published eligibility and evaluation terms, your submission and the recorded reason for rejection. Judicial review of public procurement is limited; a court does not ordinarily replace technical evaluation merely because another view is possible.
What to examine
Preserve the tender as issued, corrigenda, uploaded documents, portal acknowledgments and rejection communication. Identify an alleged departure, unequal treatment or procedural defect with specifics. The stage of award, affected bidder and public consequences can matter. A representation should not be assumed to pause either procurement or the time for a challenge.
Records to collect
- Tender and corrigenda
- submitted bid and receipt
- rejection and evaluation material available
- relevant representation
Keep complete, dated copies and preserve originals. Note which records are missing and where they may be requested; do not alter a document to fill a gap in the history.
The applicable framework
Business records should identify the legal entity, agreed terms, performance and exact amount or decision disputed. Commercial-court procedure, arbitration and sector-specific mechanisms can impose different preliminary steps and remedies. A contract label or a business address alone does not determine the competent forum or establish personal liability.
A practical next step
Prepare a criterion-by-criterion discrepancy note promptly. Assess the designated grievance route, any suitable court challenge and whether urgent relief is justified by the actual record.
