Agreement to sell versus sale deed in a Kashmir transaction
An agreement to sell records contractual obligations; a sale deed is the instrument used to complete the transfer, subject to applicable legal requirements. Paying the price or holding an agreement should not be treated as the same event as acquiring ownership through the legally required conveyance.
What to examine
Check the seller's title and authority, conditions, completion date, payment record and possession clauses. The agreement may create enforceable contractual questions without curing a title defect. If completion fails, the available response depends on the terms, conduct, readiness and legal time rules rather than the document's heading alone.
Records to collect
- Signed agreement
- title documents
- payment trail
- completion notices and proposed deed
Keep complete, dated copies and preserve originals. Note which records are missing and where they may be requested; do not alter a document to fill a gap in the history.
The applicable framework
For Kashmir property, the revenue entry, registered instrument, physical possession and underlying legal right should be examined separately. Different issues can require different authorities or civil relief. A service directory explains available services but does not replace the governing statute, current notification or an order in the particular matter.
A practical next step
Identify what remains to be performed by each side. Address authority, property description and completion obligations before assuming either ownership or an automatic refund right.
