Buying agricultural land in J&K — eligibility and restrictions to verify

A proposed agricultural-land purchase in J&K needs a current eligibility and land-category review. Citizenship or residency, agricultural classification, statutory restrictions, permissions and exemptions may matter. Do not infer eligibility solely from an agreement, a broker's assurance or a proposed non-agricultural use.

What to examine

Identify the recorded classification and the rights the seller can transfer. A later building plan does not necessarily remove restrictions on acquisition or change of use. Examine the current land-law provisions and notifications for the particular buyer and transaction, including any institutional or specially regulated ownership. Avoid using pre-reorganisation restrictions as if unchanged.

Records to collect

  • Current land classification
  • buyer-status records
  • seller's title
  • applicable permission or exemption documents

Keep complete, dated copies and preserve originals. Note which records are missing and where they may be requested; do not alter a document to fill a gap in the history.

The applicable framework

For Kashmir property, the revenue entry, registered instrument, physical possession and underlying legal right should be examined separately. Different issues can require different authorities or civil relief. A service directory explains available services but does not replace the governing statute, current notification or an order in the particular matter.

A practical next step

Obtain a transaction-specific eligibility assessment before execution or payment. Keep acquisition eligibility separate from development, conversion and registration requirements.
