LEGAL GUIDE · GOVERNMENT EMPLOYEES, RECRUITMENT AND CAT
Challenging a transfer while responding to the joining requirement
Challenging a transfer does not by itself suspend the joining requirement. Read the order, governing rules and any actual interim direction before deciding how to respond. An employee should not infer permission to remain absent from a pending representation alone.
What to examine
Record service of the transfer, relief from the current post, joining date and any approved leave. Explain the challenge and compliance position consistently. A medical or personal difficulty should be supported by relevant records and raised through the proper process. Avoid making contradictory statements about ability to join.
Records to collect
- Transfer and relieving orders
- representation
- leave or medical records
- interim court or tribunal orders
Keep complete, dated copies and preserve originals. Note which records are missing and where they may be requested; do not alter a document to fill a gap in the history.
The applicable framework
For J&K employment matters, identify the governing service or recruitment rules and amendments before applying a general principle. CAT coverage depends on the employer and subject matter, while territorial allocation is a separate question. The High Court copy of the CCA Rules is a starting text for covered matters, not proof that every employee or issue falls under those Rules.
A practical next step
Obtain prompt advice on the compliance position and available relief. Keep the existing transfer guide as the broader record-preparation reference.
