LEGAL GUIDE · PROPERTY, INHERITANCE AND REVENUE RECORDS
Construction continues despite a property injunction
When construction allegedly breaches an injunction, start with the order's exact operative terms. Identify the land, prohibited act, bound parties and evidence that the order was communicated. The fact that construction is unwelcome does not alone establish disobedience.
What to examine
Compare dated activity with the direction actually made. A status-quo order may require evidence of the relevant earlier state; an order about alienation may not address all construction. Preserve service papers and reliable photographs. The enforcement route should be based on the applicable procedural power and the relief required, not a threat of automatic imprisonment.
Records to collect
- Complete injunction order
- service proof
- earlier site condition
- dated later work and communications
Keep complete, dated copies and preserve originals. Note which records are missing and where they may be requested; do not alter a document to fill a gap in the history.
The applicable framework
For Kashmir property, the revenue entry, registered instrument, physical possession and underlying legal right should be examined separately. Different issues can require different authorities or civil relief. A service directory explains available services but does not replace the governing statute, current notification or an order in the particular matter.
A practical next step
Prepare an order-to-conduct comparison and seek prompt advice in the appropriate proceeding. Avoid physical enforcement by the parties themselves.
