LEGAL GUIDE · PROPERTY, INHERITANCE AND REVENUE RECORDS

Land classification and change of use before construction

Ownership does not automatically authorise every proposed use of land. Revenue classification, change-of-use permission and planning or building approval are related but distinct checks. A property transaction should identify the intended use before assuming an existing house or road establishes lawful conversion.

What to examine

Compare the current classification, actual use and applicable planning restrictions. Verify any permission already relied on, including its property description, conditions and issuing authority. Permission for one project or parcel should not be extended informally to another. A pending application and an approval are different stages.

Records to collect

  • Revenue classification
  • planning map
  • conversion or use permission
  • building approval and conditions

Keep complete, dated copies and preserve originals. Note which records are missing and where they may be requested; do not alter a document to fill a gap in the history.

The applicable framework

For Kashmir property, the revenue entry, registered instrument, physical possession and underlying legal right should be examined separately. Different issues can require different authorities or civil relief. A service directory explains available services but does not replace the governing statute, current notification or an order in the particular matter.

A practical next step

Prepare a use-and-permission matrix for the parcel. Identify outstanding approvals and the competent authorities before beginning work or representing the property as approved for development.
