Orchard trees and crop damage on disputed land
Orchard or crop damage needs proof of the affected interest, possession, alleged act and loss. Ownership of the land, ownership of trees and entitlement to a season's produce may require separate examination under the actual arrangement.
What to examine
Identify the trees or crop, location, season and person responsible for cultivation or harvesting. Preserve dated photographs and lawful yield, sale and expense records. Avoid overstating a future harvest as an already established loss. If the land itself is disputed, disclose that dispute and any orders controlling use or harvesting.
Records to collect
- Land and occupation records
- crop or orchard agreement
- dated damage evidence
- yield and sale accounts
Keep complete, dated copies and preserve originals. Note which records are missing and where they may be requested; do not alter a document to fill a gap in the history.
The applicable framework
For Kashmir property, the revenue entry, registered instrument, physical possession and underlying legal right should be examined separately. Different issues can require different authorities or civil relief. A service directory explains available services but does not replace the governing statute, current notification or an order in the particular matter.
A practical next step
Prepare a loss schedule with its supporting basis. Assess urgent preservation, inspection and appropriate civil or other remedies without taking retaliatory action on the land.
