LEGAL GUIDE · PROPERTY, INHERITANCE AND REVENUE RECORDS
Partition through revenue proceedings or a civil suit?
The partition route depends on the land, the recorded interests and the issues requiring determination. Revenue partition and a civil suit are not interchangeable. A dispute over title, validity of an instrument or the nature of the property can affect which forum may decide the matter.
What to examine
Separate the request to divide established shares from a dispute about whether those shares exist. Identify agricultural or other land classification, existing buildings and earlier partition proceedings. A legal assessment should examine the current jurisdiction provisions rather than selecting a forum only because the revenue record mentions the property.
Records to collect
- Title and revenue records
- classification and map
- earlier partition papers
- documents disputing shares
Keep complete, dated copies and preserve originals. Note which records are missing and where they may be requested; do not alter a document to fill a gap in the history.
The applicable framework
For Kashmir property, the revenue entry, registered instrument, physical possession and underlying legal right should be examined separately. Different issues can require different authorities or civil relief. A service directory explains available services but does not replace the governing statute, current notification or an order in the particular matter.
A practical next step
List the questions requiring a decision and the relief needed. Use the existing inheritance document checklist, then assess the competent forum and necessary parties.
