Possession litigation versus a title suit

A suit protecting possession and a suit determining title address different problems. The appropriate relief depends on the claimant's right, current possession, threatened interference and whether ownership is genuinely disputed. An injunction-only approach may not answer a substantial title dispute.

What to examine

Read the competing instruments and existing orders before choosing the claim. A person out of possession may need recovery relief; a person facing interference may need protection of an established right. The assessment must also consider whether declaration or other consequential relief is required. Avoid treating the word property dispute as a complete pleading.

Records to collect

  • Title instruments
  • possession chronology
  • interference evidence
  • competing claims and orders

Keep complete, dated copies and preserve originals. Note which records are missing and where they may be requested; do not alter a document to fill a gap in the history.

The applicable framework

For Kashmir property, the revenue entry, registered instrument, physical possession and underlying legal right should be examined separately. Different issues can require different authorities or civil relief. A service directory explains available services but does not replace the governing statute, current notification or an order in the particular matter.

A practical next step

State who occupies the property now and what the other party denies. Identify the complete practical and legal result required before selecting the suit and interim application.
