LEGAL GUIDE · PROPERTY, INHERITANCE AND REVENUE RECORDS

Buying an inherited house in Kashmir — a due diligence checklist

Buying an inherited house requires checking the predecessor's title and the route by which the proposed sellers acquired their interests. A mutation naming one relative or a family assurance is not a substitute for examining succession and any claimed releases or transfers.

What to examine

Prepare the family record, applicable succession framework and ownership chain. Identify deceased intervening heirs, minors, overseas holders and powers of attorney. Check whether the entire house is being offered or only particular shares. Occupants, tenants, mortgages and pending proceedings can affect the transaction even where succession itself is undisputed.

Records to collect

  • Title chain and death records
  • family tree
  • releases or settlement instruments
  • representative authority and occupation records

Keep complete, dated copies and preserve originals. Note which records are missing and where they may be requested; do not alter a document to fill a gap in the history.

The applicable framework

For Kashmir property, the revenue entry, registered instrument, physical possession and underlying legal right should be examined separately. Different issues can require different authorities or civil relief. A service directory explains available services but does not replace the governing statute, current notification or an order in the particular matter.

A practical next step

List every interest needed for the proposed purchase and how it will be transferred. Resolve authority and share questions before paying for a whole-property conveyance.
