LEGAL GUIDE · PROPERTY, INHERITANCE AND REVENUE RECORDS

Checking mortgages and encumbrances before buying property

A pre-purchase check should investigate registered encumbrances, relevant title and revenue records, existing loans, possession and pending disputes. A single certificate or clean-looking extract should not be treated as a guarantee that every liability or competing claim has been found.

What to examine

Ask how the seller obtained the property and where the original documents are held. Review lender releases, recorded charges, litigation and the authority of each seller. Searches have limits, including the records and periods covered. Explain those limits rather than describing an unexplained portal result as a clear-title certificate.

Records to collect

  • Title chain
  • search results and their periods
  • loan discharge documents
  • possession and case records

Keep complete, dated copies and preserve originals. Note which records are missing and where they may be requested; do not alter a document to fill a gap in the history.

The applicable framework

For Kashmir property, the revenue entry, registered instrument, physical possession and underlying legal right should be examined separately. Different issues can require different authorities or civil relief. A service directory explains available services but does not replace the governing statute, current notification or an order in the particular matter.

A practical next step

Resolve material gaps before completion. Record what was searched, what remains unverified and which documents or releases must be produced at the transaction stage.
