LEGAL GUIDE · PROPERTY, INHERITANCE AND REVENUE RECORDS
A property is sold while litigation is pending
A transfer during pending litigation should be reviewed against the nature of the suit, the property and any actual restraint order. A pending case and an express injunction have different legal effects; do not assume that every later sale is automatically void.
What to examine
Obtain the plaint, relief claimed, order sheets and the complete later deed. The principle governing transfers during property litigation can affect the purchaser's position, while breach of a specific order raises additional issues. Identify dates and notice carefully. The remedy may involve the purchaser's participation and the final relief in the existing case.
Records to collect
- Suit pleadings
- interim orders
- later deed
- service and transaction dates
Keep complete, dated copies and preserve originals. Note which records are missing and where they may be requested; do not alter a document to fill a gap in the history.
The applicable framework
For Kashmir property, the revenue entry, registered instrument, physical possession and underlying legal right should be examined separately. Different issues can require different authorities or civil relief. A service directory explains available services but does not replace the governing statute, current notification or an order in the particular matter.
A practical next step
Map the transaction against the proceeding and orders. Ask what effect it has on the claim and whether a targeted interim or procedural application is required.
