LEGAL GUIDE · KASHMIR MATTERS FOR PEOPLE LIVING ABROAD

Family members occupy an overseas owner's house

When relatives occupy an overseas owner's house, identify whether their position is based on co-ownership, tenancy, permission, guardianship or another arrangement. Those categories affect the available remedy. Family relationship and long occupation do not by themselves settle the legal position.

What to examine

Collect the title, inheritance and occupation history and identify any acknowledgment of the owner's rights. Distinguish a dispute over permission from a genuine competing title claim. A notice should accurately reflect the arrangement and requested relief. Changing locks or removing belongings without lawful process can create additional problems.

Records to collect

  • Title and share records
  • occupation agreement or communications
  • rent or expense records
  • existing proceedings

Keep complete, dated copies and preserve originals. Note which records are missing and where they may be requested; do not alter a document to fill a gap in the history.

The applicable framework

A Kashmir matter involving someone abroad can require both Indian legal compliance and documents executed in another country. Authentication, stamping, registration, authority and appearance are separate questions. An apostille or consular act does not by itself decide the underlying property right, foreign judgment effect or permission required by an Indian court.

A practical next step

Prepare a possession and permission chronology. Assess termination, partition, recovery or other relief according to the occupier's actual legal position.
