Pre-institution mediation before a commercial suit
Section 12A of the Commercial Courts Act requires exhaustion of pre-institution mediation for covered suits that do not contemplate urgent interim relief. A genuine urgency assessment matters; adding an urgent-sounding prayer does not automatically resolve the requirement.
What to examine
Identify the dispute, proposed defendants, value, documents and relief before starting the process. The statute and applicable Rules govern the designated authority and outcome record. Settlement discussions do not excuse careless limitation calculations. If urgent court protection is sought, explain the concrete threatened harm and why waiting would matter. Keep the completion or non-starter record for a later suit.
Records to collect
- Contract and claim ledger
- proposed relief and urgency evidence
- party and service details
- mediation application and outcome record
Keep complete, dated copies and preserve originals. Note which records are missing and where they may be requested; do not alter a document to fill a gap in the history.
The applicable framework
Business records should identify the legal entity, agreed terms, performance and exact amount or decision disputed. Commercial-court procedure, arbitration and sector-specific mechanisms can impose different preliminary steps and remedies. A contract label or a business address alone does not determine the competent forum or establish personal liability.
A practical next step
Assess section 12A before filing. Use the designated process where required and preserve the record showing how the requirement was addressed.
