A business partner is accused of diverting funds
An allegation that a partner diverted funds needs a transaction-based examination. Separate unauthorised withdrawals, disputed drawings, accounting errors, remuneration and genuine business expenditure. Civil accounting, contractual relief and criminal allegations have different requirements.
What to examine
Preserve bank statements, access rights, invoices, approvals and the partnership or entity documents. Secure records lawfully without deleting accounts or excluding a person contrary to an agreement or order. A suspicion based on a falling balance is not a substitute for tracing payments. Any urgent request to restrain transactions should identify a concrete risk and the proper forum.
Records to collect
- Entity or partnership documents
- bank and ledger entries
- approval and invoice records
- communications about the disputed transactions
Keep complete, dated copies and preserve originals. Note which records are missing and where they may be requested; do not alter a document to fill a gap in the history.
The applicable framework
Business records should identify the legal entity, agreed terms, performance and exact amount or decision disputed. Commercial-court procedure, arbitration and sector-specific mechanisms can impose different preliminary steps and remedies. A contract label or a business address alone does not determine the competent forum or establish personal liability.
A practical next step
Build a dated transaction schedule with supporting records. Assess an accounting, preservation or recovery route and any independently supported criminal issue separately.
