LEGAL GUIDE · CRIMINAL PROCESS AND BAIL
A bank account is frozen during a cybercrime investigation
A frozen bank account may involve a police direction, cybercrime reference, bank hold or court order. Ask the bank for the available written basis and identify the investigating agency and amount affected. A complaint made in another district may require coordination beyond Srinagar.
What to examine
Preserve statements showing the disputed transfer and legitimate surrounding transactions. A request for release should explain ownership, source of funds, the alleged transaction link and practical hardship where relevant. Neither a bank employee's assurance nor a complaint portal status guarantees de-freezing. Do not move money through alternate accounts to defeat an operative restriction.
Records to collect
- Bank freeze communication
- account statement and disputed transaction ID
- complaint or FIR reference
- source-of-funds records
Keep complete, dated copies and preserve originals. Note which records are missing and where they may be requested; do not alter a document to fill a gap in the history.
The applicable framework
Criminal procedure must be matched to the alleged offence, case stage, applicable special statute and any transition from the older laws. Bail, investigation, trial and property-release questions can follow different provisions. Official case information helps locate the matter; the complete police and court records are needed to assess the particular application.
A practical next step
Identify the authority responsible and the competent process for a reasoned release request. Keep the bank, investigation and any court directions aligned in the written record.
