LEGAL GUIDE · PROPERTY, INHERITANCE AND REVENUE RECORDS
The original property deed is lost
If an original property deed is lost, investigate the official registration record and preserve the remaining title history. A certified copy may help establish the recorded instrument, but obtaining one does not cure an unrelated title defect or establish that no lender holds the original.
What to examine
Record when and how the loss was discovered, whether the document was deposited with a bank or representative, and who last had custody. Distinguish a lost original from an instrument that was never executed or registered. Any proposed transaction should explain the missing original honestly and address the relevant record and lender checks.
Records to collect
- Registration particulars
- available copy
- custody correspondence
- loan or deposit records
Keep complete, dated copies and preserve originals. Note which records are missing and where they may be requested; do not alter a document to fill a gap in the history.
The applicable framework
For Kashmir property, the revenue entry, registered instrument, physical possession and underlying legal right should be examined separately. Different issues can require different authorities or civil relief. A service directory explains available services but does not replace the governing statute, current notification or an order in the particular matter.
A practical next step
Apply for the appropriate official record and document the loss accurately. Check the requirements of the receiving court, authority, lender or purchaser before substituting an informal photocopy.
