LEGAL GUIDE · PROPERTY, INHERITANCE AND REVENUE RECORDS

The seller refuses to complete registration

A seller's refusal to complete registration may justify examining contractual and specific-performance remedies, but the agreement, the parties' obligations and the buyer's conduct must be assessed. A refusal does not automatically convert the purchaser's agreement into ownership.

What to examine

Identify any unmet condition, title problem, financing issue or dispute about the balance price. Preserve evidence of the proposed completion and the buyer's ability and willingness to perform the obligations actually owed. A later sale or threatened transfer may raise additional party and interim-relief questions. Avoid sending notices that inaccurately state the payment or completion history.

Records to collect

  • Agreement
  • payment and available-funds evidence
  • completion correspondence
  • title and later transaction records

Keep complete, dated copies and preserve originals. Note which records are missing and where they may be requested; do not alter a document to fill a gap in the history.

The applicable framework

For Kashmir property, the revenue entry, registered instrument, physical possession and underlying legal right should be examined separately. Different issues can require different authorities or civil relief. A service directory explains available services but does not replace the governing statute, current notification or an order in the particular matter.

A practical next step

Record the refusal and every relevant date. Have the proposed relief, necessary parties and limitation assessed promptly instead of assuming negotiations suspend time.
