Mediation & arbitration
A dispute can call for dialogue, a private adjudicative process, court proceedings or a combination. The choice begins with suitability and the governing framework.
The matters covered
Arshie Zuhar has completed mediation and arbitration training at the Indian Institute of Arbitration & Mediation (IIAM), Kerala. The practice considers preparation and representation in suitable civil, family and commercial disputes.
Mediation helps parties explore a voluntary resolution with the assistance of an impartial mediator. Arbitration ordinarily involves an arbitral tribunal deciding a dispute within a valid arbitration framework. The role, procedure and legal effect differ.
Records for an initial review
- The agreement and any dispute-resolution clause.
- A short chronology, the central issues and the documents supporting each position.
- Previous notices, offers, court orders and any agreed procedural rules.
- Details of who has authority to negotiate, settle or give binding instructions.
How the next step is assessed
The review considers suitability, consent, safety, conflicts, the applicable agreement and any live court deadline. Participation in discussions does not automatically pause other proceedings.
Counsel and independent-neutral roles are distinct. An appointment as mediator or arbitrator, if considered, requires separate agreement and applicable independence checks. The legal effect of a settlement depends on the route and required formalities.
Questions that often arise
Does mediation require a settlement?
A mediator assists discussion rather than imposing the parties’ agreement. A proposal should be considered freely, with legal advice where needed.
Does the IIAM training mean a panel appointment?
The profile records completed training. It does not claim accreditation, panel membership or an appointment in a particular dispute.
Is every dispute suitable for arbitration?
No. The agreement, the dispute and the law determine whether arbitration is available. Family-status and other reserved matters cannot simply be moved to private arbitration.
